General Terms of Use - Social Media Registration

PREAMBLE

1. Bpifrance (hereinafter referred to as "Bpifrance"), a public limited company with a capital of €5,440,000, registered with the Créteil Trade and Companies Register under number 320 252 489, with its head office located at 27-31, avenue du Général Leclerc – 94710 Maisons-Alfort Cedex, publishes this form (hereinafter the "Form") to manage participation in the event organized by Bpifrance (hereinafter the "Event").

2. You can register for the Bpifrance Event via certain social media platforms (hereinafter the "Social Media Platform(s)") by completing the registration form.

3. You can then visit the Event's website (hereinafter the "Website"), available at this link: [insert Website link], to create and use a user account (hereinafter the "User Account" or "Account"). The Account is provided to users free of charge, securely, in accordance with current best practices, and uses internet technologies.

These General Terms of Use (hereinafter the "General Terms of Use" or "GTU") define the terms under which a participant in the Bpifrance Event can register for it, create an Account on the Website as a Participant User (hereinafter "Participant User") or as a Partner User (hereinafter "Partner User").

1. FORM

By accessing the Form, you unconditionally accept the following elements:

1.1 Intellectual Property

The Form and each of its components, including but not limited to texts, articles, newsletters, brochures, plans, word clouds, images, illustrations, photographs, databases, and software (hereinafter the "Intellectual Property Elements"), are protected by intellectual property rights. Total or partial reproduction of the Intellectual Property Elements is prohibited. The User is only authorized to display the Form on their screen and may only reproduce the Intellectual Property Elements temporarily for consultation purposes.

1.2 Use of the Form

All data, information, and publications accessible, displayed, or downloadable from the Form are provided for informational purposes only and cannot under any circumstances be considered as constituting an offer of services or products, legal advice, solicitation, or canvassing. Consequently, Bpifrance cannot guarantee the completeness or absence of modification by a third party (e.g., viruses, intrusions) and declines all responsibility in this regard. Bpifrance cannot under any circumstances be held liable for any direct or indirect damage resulting from the use by any user of the data, information, or publications accessible or downloadable from the Form.

Bpifrance cannot under any circumstances be held liable for the content accessible via hypertext links published on the Form or for downloadable files or websites accessible via hypertext links published on it. The creation and publication of a hypertext link to one of the Form's pages are authorized, subject to the prior and express approval of Bpifrance.

2. RESERVED AREA FOR EVENT PARTICIPANTS ON THE WEBSITE

2.1 Event Registration

The Participant User has the option to register for the Event directly via certain Social Media Platforms by completing the Event registration form available on the relevant Social Media Platform (hereinafter the "Registration"). A confirmation of Registration for the Event is sent to the Participant User via the email address provided.

2.2 Opening and Features of the Participant Area

Following Registration, if Bpifrance offers this option on the Website, the Participant User can create an Account. The Account allows the Participant User to access the Participant Area and thus the Features described in the Website's General Terms of Use.

3. RESERVED AREA FOR PARTNER COMPANIES AT AN EVENT ON THE WEBSITE

3.1 Event Registration

If a Partner User wishes to participate in the Event, they can complete the registration form on the relevant Social Media Platform, just like any other Event participant. The Partner User, like any Participant User, will receive a confirmation email for the Event Registration at the email address provided during Registration.

3.2 Opening and Features of the Partner Area

Following Registration, if Bpifrance offers this option on the Website, the Partner User can create an Account to manage their participation in the Event and access the Partner Area, which is accessible from their Participant Area. The Partner User can access the Features described in the Website's General Terms of Use from their Partner Area.

In any case, Bpifrance reserves the right to activate or not activate the Features as described in the aforementioned General Terms and may modify the Features of the Partner Area at any time, without this entitling Partner Users and/or the Partner Company to any compensation.

4. CREATION OF A USER ACCOUNT AND ACCESS TO THE PARTICIPANT AREA AND PARTNER AREA

4.1 Creation of a User Account

4.1.1

Following Registration, and if Bpifrance offers this option on the Website, the Participant or Partner User can create an Account. The Account allows access to the Participant Area and the Partner Area on the Website. The Account's Username and Password allow access to both the Partner Area and the Participant Area.

4.1.2

Thus, if offered on the Website, the User can access a Participant Area and/or Partner Area on the Website, allowing them to access the Features according to the rights granted to them and based on the nature of the event.

Any User with access to the internet and the required technical equipment can create an Account on the Website if they meet the cumulative conditions defined in this article. The User is informed that all costs related to accessing the Website, the Account, and the Intranet, such as hardware costs and subscription fees with an internet service provider, including any applicable taxes, are their sole responsibility.

4.1.3

To create an Account, the following conditions must be met:

  • The User must have completed their Registration for the Event by filling out the Form;
  • Account creation must be offered by Bpifrance on the Website;
  • The User must create a Password on the Website according to the criteria set by Bpifrance;
  • The User must have accepted these General Terms of Use at the time of Registration, as well as the Website's General Terms of Use when creating the Account.

5. ACCEPTANCE OF THE GENERAL TERMS OF USE

By checking the following box: "By checking this box, I acknowledge that I have read and accept the General Terms of Use of the Form and have taken note of the information regarding the processing of personal data collected and processed, available in the 'Protection of Personal Data' section", the User acknowledges:

  • Having read and expressly accepted them;
  • Agreeing to comply with them at all times and under all circumstances from the time of Registration;
  • Being fully aware of their obligations.

6. USER OBLIGATIONS

The User undertakes to:

  • Act sincerely and fairly when completing the Form; and
  • Not enter and/or disseminate information contrary to public order.

7. INTELLECTUAL PROPERTY

7.1

The Form and each of its components, including but not limited to texts, photographs, trademarks, logos, sounds, music, layouts, drawings, models, icons, computer codes, software, fonts, and more generally, all visual or audio elements (hereinafter the "Intellectual Property Elements"), are protected by intellectual property rights of which Bpifrance is the holder or of which its service providers are the holders, or which have been licensed to Bpifrance by third parties.

The User is therefore prohibited from any act of reproduction or representation of the Intellectual Property Elements not expressly and previously authorized by Bpifrance, as such reproduction and/or representation may constitute an act of counterfeiting.

7.2

The User may not use the names Bpifrance or any name mentioning Bpifrance, such as Bpifrance, trademarks, logos, and all associated distinctive signs, which, as the case may be, are the property of Bpifrance or another company in the Bpifrance Group as defined in Article 15 of these GTU.

7.3

It is strictly forbidden to establish hypertext links or to publish the Form online.

8. LIABILITY

8.1

The User expressly acknowledges:

  • That in the event of non-compliance with these General Terms of Use, the liability of Bpifrance, any other company in the Bpifrance Group, or another User cannot be engaged;
  • That Bpifrance's liability cannot be engaged in the event the User communicates inaccurate or incomplete information on the Form, or due to the configuration of their browser allowing automatic identification, thereby enabling a third party, if applicable, to register for the Event;
  • That Bpifrance or any other company in the Bpifrance Group cannot be held liable for any potential consequences of a breach or lack of diligence by the User in the use and/or completion of the Form.

8.2

The User undertakes to hold Bpifrance and/or any other company in the Bpifrance Group harmless from any costs, expenses, or damages in the event that all or part of them are challenged by another User and/or a third party for an act attributable to the User, particularly resulting from the use of the Form in a manner that does not comply with these GTU, French, European, and, where applicable, international laws and regulations.

8.3

The User undertakes to exempt Bpifrance from any contribution to all damages, interests, compensation, and costs of any kind that may be awarded against the User following damage resulting from the use of the Form in a manner that does not comply with these GTU, French, European, and, where applicable, international laws and regulations.

8.4

The User acknowledges being fully informed of Bpifrance's possibility to temporarily suspend and/or permanently delete the Registration at any time due to technical or regulatory constraints or in any case of violation of these General Terms of Use by the User.

8.5

The Form is provided as is. Given this fact, recognized and accepted by the User, Bpifrance cannot be held liable for the temporary or permanent inability of the User to access the Form. Bpifrance's obligation to provide is limited to a best-efforts obligation. Bpifrance does not guarantee the durability or performance of the Form. Bpifrance does not guarantee that the Form it provides to Users is free of bugs; technical incidents are always possible.

Bpifrance cannot be held liable for any potential damage to hardware, software, or data (e.g., viral contamination) suffered by the User as a result of accessing or using the Form.

8.6

The liability of Bpifrance or any company in the Bpifrance Group cannot be engaged in the event of force majeure as defined by French law and jurisprudence.

9. PROTECTION OF PERSONAL DATA

9.1 Data Controller, Purposes, and Legal Bases

In accordance with applicable regulations, in particular European Regulation 2016/679, known as the General Data Protection Regulation (GDPR), and national provisions relating to information technology, files, and freedoms, Bpifrance, as the data controller, collects and processes your personal data:

  • Based on the execution of the GTU to:
    • Allow acceptance of the GTU;
    • Allow the organization and management of the User's registration and participation in the Event securely and, where applicable, their unregistration;
    • Send information, notifications, and alerts related to the Event to Users by email or SMS;
    • Provide User support related to the organization of the Event;
  • Based on its legitimate interest in improving customer knowledge, developing, and managing its relationships, particularly commercial relationships with its prospects and customers, for the implementation of the following purposes:
    • Feeding Bpifrance's customer/prospect database;
    • Commercial prospecting and animation by email and/or telephone;
    • Sending communications (by email or SMS) of a commercial nature and/or related to Bpifrance's news/events and/or products and services (including sending Newsletters related to the Event the User has registered for), which may, where applicable, correspond to the User's needs and/or interests as identified by Bpifrance based on the User's profile;
    • Managing preferences and subscriptions to Newsletters;
    • Measuring User satisfaction and compiling usage statistics for the Form (preparing reports and commercial statistics).
  • Based on Bpifrance's legitimate interest in communicating about events related to its activities for the implementation of the following purposes:
    • Capturing Images and Videos (e.g., filming during and after conferences, workshops, seminars, conventions, and/or events);
    • Reproducing and distributing Images and Videos;
    • Using Images and Videos, particularly for Bpifrance's internal and/or external communication;
    • Transcribing from voice to create summaries or reports of discussions.
  • Based on its legitimate interest in defending its rights and interests for the implementation of the following purposes:
    • Managing complaints and disputes related to the execution of these General Terms of Use, where applicable, traceability, and proof of operations and due diligence carried out by the User within the framework of the Form submitted by Users.

9.2 Data Collected

The personal data collected through the Form is as follows: last name, first name, email, position, company, country (hereinafter the "Data").

9.3 Data Recipients

The Data is intended for Bpifrance and will also be communicated, in whole or in part, to:

  • Internal employees of the Bpifrance Group companies involved in organizing the Event;
  • Bpifrance's service providers responsible for the technical management of the Form, digital marketing operations at Bpifrance, and the operational management of the Event;
  • They may also be communicated to any administrative, judicial, or regulatory authority that has a right to communication based on a legislative provision as part of a French or European administrative or judicial procedure, upon their request.

9.4 Data Retention Periods

Personal Data is retained by Bpifrance for a period not exceeding that necessary to achieve the purposes specified above, increased where applicable by the legal and regulatory limitation periods in France and Europe.

9.5 Data Protection Officer, User Rights, and Exercise Modalities

Bpifrance has appointed a Data Protection Officer whom the User can contact using the coordinates provided in this Article.

In accordance with the GDPR and national provisions relating to information technology, files, and freedoms, and subject to the conditions provided for by this regulation for the exercise of these rights, the User has the right to access, rectify, and erase their Personal Data, as well as the right to data portability.

The User also has the right to request the restriction of processing concerning them and the right to object, for reasons relating to their particular situation, to the processing of their data, including profiling. Finally, the User has, in accordance with national provisions relating to information technology, files, and freedoms, the right to organize the fate of their Personal Data posthumously.

Finally, the User has the right to file a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) if they believe that the processing operations described infringe on their rights.

9.6 Transfer of Data Outside the EU

Personal Data transmitted to Bpifrance will not be transferred to a country outside the European Union or to an international organization.

However, given the nature of the digital media used by Bpifrance (websites, social media platforms including X (formerly Twitter), Facebook, Instagram, LinkedIn, TikTok), and online video platforms (YouTube), you are expressly informed that images, videos, and animated sequences produced during Events may be visible outside the European Economic Area.

10. COOKIES

When browsing the Website, information related to the navigation of your device (computer, tablet, smartphone, etc.) on our Website may be recorded in text files called "Cookies," installed on your device, subject to your choices regarding Cookies, which you can modify at any time. Bpifrance uses information related to navigation on the Website in accordance with its cookie policy available at the following address: Cookie Policy.

The Website also uses strictly necessary Cookies for its operation, provided by Bpifrance's service provider.

11. SEVERABILITY OF THE GENERAL TERMS OF USE

These General Terms of Use constitute an inseparable contractual whole.

The User agrees that in the event of the cancellation of a clause of the General Terms of Use, they will remain subject to the application of the other provisions.

12. NON-WAIVER

The fact that Bpifrance does not enforce a breach by one or more User(s) of any of the provisions of these General Terms of Use cannot be interpreted as tolerance or a waiver of its right to enforce such a breach in the future.

13. UPDATE OF THE GENERAL TERMS OF USE

Bpifrance reserves the right to modify and update these General Terms of Use at any time. Bpifrance will endeavor to inform Users of such changes.

Users undertake to read the entirety of any new version of the General Terms of Use and to comply with them.

14. LAW AND JURISDICTION OF COURTS

These General Terms of Use are governed and interpreted in accordance with the provisions of French law.

In the absence of finding an amicable solution within a reasonable timeframe, disputes related to the General Terms of Use and the use of the Form shall be subject to the exclusive jurisdiction of the French courts.

15. GLOSSARY

This glossary is an integral part of the General Terms of Use.

"Email Address": refers to the professional email address provided by the Participant or Partner Company during their registration for the Event, which constitutes their Username.

"Account or User Account": refers to the dedicated space provided by Bpifrance free of charge to Users, accessible on the Website after authentication, allowing them to manage their participation in the Event.

"General Terms of Use" or "GTU": refers to these General Terms of Use of the Form accessible via Social Media Platforms.

"Features": refers to the actions made available to Users as part of their use of their Accounts (Participant Accounts and Partner Accounts) on the Website. They are described in more detail in the Website's General Terms of Use.

"Personal Data" or "Data": refers to any information relating to an identified or identifiable natural person, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.

"Partner Companies": refers to legal entities participating in the Event as sponsors or exhibitors.

"Event": refers to the event organized by Bpifrance.

"Username": refers to the User's Email Address.

"Password": refers to the sequence of characters chosen by the User when creating their Account, constituting their personal and confidential code, which, combined with their Username, allows them to access said Account.

"General Data Protection Regulation (GDPR)": refers to the European rules relating to the protection of natural persons with regard to the processing of personal data and the rules relating to the free movement of such data. They protect the fundamental rights and freedoms of natural persons, and in particular their right to the protection of personal data.

"Social Media Platform" or "Social Media Platforms": refers to any online social media platform allowing Users to create a personal account (Facebook, LinkedIn, Instagram, etc.) and to register for the Event.

"Bpifrance Group Company" or "Bpifrance Group Companies": refers to all companies directly or indirectly controlled by the public limited company Bpifrance, with a capital of €20,847,285,577.04, whose head office is located at 27-31 avenue du Général Leclerc, 94700 Maisons-Alfort, registered with the Créteil Trade and Companies Register under number 507 523 678. All these companies are supervised either by the Prudential Supervision and Resolution Authority or by the Financial Markets Authority.

"Participant" or "Participants": refers to any natural person, acting in the context of their professional activity or studies, registered for the Event under the conditions defined by Bpifrance.

"User": refers to participants, speakers, or partner companies using the Website.

"Partner Users": refers to employees of the Partner Company added to the Partner Account by Bpifrance, authorized to access and use the Features of the Partner Account based on the specific rights granted to them.
